Whether it’s a mobile application, an ERP (Enterprise Resource Planning) system, or a website, your source code is yours. There are some technical tools you can use to protect it from copycats, but those are not always enough. We can give you some extra legal tools.
First and foremost, there’s IP protection on your software. The difficulty is that it is split between the graphics (such as the interface) and the code (back-end). But that shouldn’t stop you from getting the protection you need!
You have an automatic, free copyright on your software. The only tricky part is to prove you’re the programmer or author of the code, which isn’t always easy with just notes and documentation. One of the tools we can offer you is to put your source code in a software escrow.
A software escrow is a way to ‘store’ your source code and give it a set date, proving the exact moment when you developed it. You can just keep the source code vaulted, or you can request a (secure) FTP copy. Moreover, an escrow can also be used to give your licensees some guarantees and gain their trust: if your company should go bankrupt, software in escrow can be released or kept up and running for their benefit.
