Protect the design of models and drawings.
Creations don’t happen overnight. Usually it is the result of long hours of brainstorming, hard work and a touch of inspiration. You should make sure nobody else profits of that hard work without your consent.
So, if you’re looking for a way to protect the particular shape of an object you designed, or the drawings you created, you can protect both by a design right. That’s right, designs can be protected both in 2D (drawing) and 3D (model). The protection lasts for 5 years and can be renewed up to four times, with a maximum time limit of 25 years.
The protection covers the physical aspects of the product, such as its appearance, shape and aesthetics, but not its functional aspects. Inventions are protected by a different intellectual property right, namely patents.
Be careful, a drawing or model can’t have been made public before registration: this could form an obstacle to the requirement that the design must be new. There are some exceptions to this rule. If you’re in this situation, don’t hesitate to contact us and check what your options are.
